In 2012 Maya Kodnani, former BJP minister, was sentenced to jail for her role in the Naroda Patiya massacre where 97 muslims were killed during the 2002 Gujarat riots. She was held by the trial court as the mastermind of gruesome killings of innocents including women & children. Today, she has been acquitted. Her acquittal is continuation of a disturbing trend in judicial pronouncements with regard to politically important and sensitive cases. A pattern seems to have emerged – persons found guilty of serious and heinous crimes when a particular political party is in power are found not guilty when its rival political party comes to power. While 3-stage review of judicial pronouncements is part of the Indian judicial system and such review can lead to judgements of lower courts being over-turned by higher courts, the emerging string of such cases relating to political functionaries make them unusual, if not questionable. The net result is that citizens for whom Indian democracy exists may begin to doubt the judiciary and raise questions about its independence. This is extremely dangerous and damages the very root of our nation’s constitutional democracy where judiciary is expected to be a strong & independent pillar of creating checks and balances.

Swaraj India calls upon the judicial establishment to take note of this deepening crisis of faith in the judiciary and the perception that the top judiciary is being used for political purposes through interferences from the executive. Urgent action must be taken to restore unquestioning faith and trust in the independence, accountability and efficiency of the Indian judiciary.
